San Jose needs more medical marijuana clubs! Sixteen registered clubs are too few to meet patient needs. San Jose is a regional market that serves Silicon Valley and has an obligation to meet patient needs for the region now and into the future. Denver, Colorado is two-thirds the size of San Jose and it has 424 medical and recreational dispensaries - State regulations MMSRA are in place and a few more dispensaries will improve access,  increase selection, and create a stable market.

Existing State and Federal regulations will always be in place protecting our children.  Federal rules prevent the sale/use/cultivation of marijuana within 1000 feet from schools.  State penalties also prevent the sale/use/cultivation of marijuana within 600 feet from schools.

The City of San Jose has created a legal monopoly for a medicine.  A handful of dispensaries have been given monopoly power to gouge the sick, recovering, cancer stricken, depressed, patients of Northern California.  The reality of the situtation, San Jose is the only city in the South Bay outside of Santa Cruz to offer medication for the millions of people in the South Bay. 

The city's discriminating regulations conflict with state laws on many levels.  The MMSRA was passed by the State legislature early September 2015 and precludes San Jose's vertical integration (the entire process from seed to sale under 1 roof).  Unfortunately the very restrictive zoning means that very few parcels in the city are viable for MMJ and of those how many are on the market with landlords who want a MMJ tenant.

Marijuana legalization is on the November California ballot via the AUMA.  San Jose's ordinance creates a monopoly in a market about to double or triple, convenient isn't it?
